Welcome to Kelson Hauling & Landscape. These Terms & Conditions ("Terms") govern your use of our website and the hauling and landscaping services we provide. By requesting an estimate, booking a service, or otherwise engaging with Kelson Hauling & Landscape, you agree to be bound by these Terms.

1. Scope of Services

Kelson Hauling & Landscape provides premium landscaping, property transformation, and heavy hauling services. All work will be performed according to the specific scope outlined in the approved written estimate or service agreement. Any additional work requested outside of the original scope ("scope creep") will require a separate agreement and may incur additional charges.

2. Estimates, Billing, and Payments

• Estimates: All quotes and estimates are valid for 15 days from the date of issue. Prices are subject to change if the scope of the project is altered by the client or if unforeseen site conditions are discovered.

• Deposits: For landscaping projects and large hauling jobs, a non-refundable deposit of 25% plus any project specific materials is required to secure your spot on our schedule and procure the necessary materials.

• Final Payment: The remaining balance is due in full upon completion of the specified services. We accept most major credit cards, bank transfers, cash, and Venmo.

• Late Fees: Invoices not paid within 10 days of completion are subject to a late fee of 1.5% per month.

3. Client Responsibilities & Property Access

To ensure we can deliver top-tier results safely and efficiently, the client agrees to the following:

• Access: Provide clear and unobstructed access to the property and work area for our trucks, equipment, and crew during scheduled service hours.

• Underground Utilities: The client is responsible for identifying and clearly marking all private underground utilities, including sprinkler lines, invisible fences, and custom drainage pipes, before work begins. Kelson Hauling & Landscape is not liable for damage to unmarked private underground lines. We will coordinate with local authorities (e.g., Blue Stakes) for public utilities where applicable.

• Permits: Unless otherwise specified in writing, the client is responsible for obtaining any necessary HOA approvals or local permits required for the landscaping or hauling work.

4. Scheduling and Weather

Our services are inherently dependent on weather conditions. While we strive to adhere strictly to our scheduled timelines, Kelson Hauling & Landscape reserves the right to postpone or reschedule services due to severe weather, unsafe conditions, or equipment delays. We will communicate any schedule changes promptly.

5. Limitation of Liability

While we operate with the highest standards of professionalism and care, the nature of heavy hauling and landscaping involves heavy equipment and materials.

• Kelson Hauling & Landscape shall not be held liable for unavoidable minor damage to driveways, sidewalks, or existing turf that occurs during the normal, careful operation of our trucks and equipment.

• Our total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the client for the specific project in question.

6. Intellectual Property

All content on this website, including our logo, high-contrast brand assets, text, and photographs of our past projects, is the exclusive property of Kelson Hauling & Landscape. It may not be copied, reproduced, or used by any third party without our express written consent.

7. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Utah. Any disputes arising from these Terms or our services shall be resolved in the appropriate courts located in or near Sandy, Utah.
